How do I fire someone without getting into trouble?
Terminations are difficult and should come as no surprise to the employee. If the termination is based on just cause, and if the construction employer has documented the employee’s infractions, termination can be short and simple. The immediate supervisor should handle it professionally, and the employee should be told why the decision has taken place.
How do I fire someone I don’t like or don’t want as an employee who has not given just cause for termination? This is a legal issue that should be professionally consulted on, however if there are no performance or infraction grounds to justify the termination, many construction employers will simply tell the employee straight out what the issue is. Others will tell stories such as they have to lay them off due to budget cutbacks or department refocusing. To reduce the anxiety surrounding an employee’s dismissal, a small severance or insurance coverage extension can be offered. However some lawyers will insist that if anything financial is given to the employee, then they should get the employee to sign a waiver not to sue them for any cause.
